FAA Lawsuit - AMA response/update

The lawsuit challenging the FAA registry was filed in the Court of Appeals for the District of Columbia on December 24 by a model aircraft enthusiast concerned that the registration rules were illegal. That individual is John A. Taylor, a multi-rotor builder and flyer living in Silver Spring, Maryland. An insurance attorney, Mr. Taylor is representing himself. He started flying model aircraft approximately one year ago and has become passionate about the hobby. He expected other hobby groups or drone manufacturers to file suit against the registration rules but when they didn’t, he decided to step up himself. Although he plainly admits that he has no aviation or administrative law experience, as a long-time litigator, he says he’s up to the challenge.

Mr. Taylor is requesting that the court “issue an order declaring that the [FAA's registration rule] is void” and prohibited by Section 336 of the FAA Modernization and Reform Act of 2012. He alleges that that section specifically prohibits the FAA from promulgating any new rules or regulations regarding model aircraft if they’re flown for hobby or recreational purposes.

Somewhat surprisingly, the legal challenge does not come – as many hobbyists expected – from the Academy of Model Aeronautics.

But he's wrong about no one else filing suit. Didn't AMA challenge the rule last August?

Still, the more the FAA is forced to defend this abortion the better.

If the AMA has attempted any legal recourse against the FAA they sure have been quiet about it.

Yep,, and they are the main reason I am holding off the registration, to
see just what ends up happening for sure.

Hopefully, now that all the holidays are behind and done, things will get
rolling........either for the better or worse.

On a side note, did anyone see on the 'other' site, about a Control-Line
ONLY field just got shut down by the FAA too. A cont. line field!

I just don't get the anger at registering. I am already in several federal databases. I have nothing to hide. I don't buy the slippery slope though I agree that the registration might lead to more restrictions in the future. Want to fly, you register, you fly almost immediately. $5 is chump change in this hobby.

I would not waste my time and money fighting this issue. Instead, I would be filing suit about shutting down all flying within SFRA areas. That affects many people and could affect a lot more in the future.

The problem that I have is that vast area are being closed for one reason. That reason is fear. There was no due process, no notice, no appeal, no process for grandfathering existing facilities. We have to stop letting the alphabet boys scare everyone. We are not the enemy, we are part of the solution.

Registering is just not that big of a problem. Just do it.

Two things.

1. The AMA has had a suit pending on this for ages

2. The registration is no big deal, the back door that you have to agree to 400 feet if you register is problematic with many facets of the hobby though this crowd in general shouldn't have a big issue with it.

AMA just sent out an email with a number of documents and a video explaining where they are at today. I do support AMA and am glad to be a member. I'm a bit frustrated by the action the FAA has taken and what appears (on the surface) to be a soft response from AMA but will continue to support the AMA since they are the best organization we have for supporting model aviation.

This regulation makes flying a T450 or even a T250 (without regristration) a $27,000 crime.
what's 5$ worth by donating your 5$ to the faa your saying you agree with them

Just because a law is BS doesn't mean I want to test it. I'll wait as long as I can stand it, but honestly, what's going to change in a month? My expectations are low. I think the AMA just cost me $5. LOL. That said, I have $5 worth of faith in them. Not going to jump ship over $5.

That said, after the deadline, I'm in compliance. I'm not going to martyr myself to the tune of $27,000 trying to make some idealistic point. You can try to use shaming language to change people's behavior, but AMA won't be calling for that, and most level headed people are just going to pony up the $5 eventually.

No-one has to be a martyr they just need to be patient and wait and not jump the gun

nothing stopping you from flying atm except for weather and daylight
if you don't have a non ama field to fly at, find one. google maps is great for this.

Yeah we shouldn't fight this and follow our fellow gun guys and how they lose a little bit each time the GOV gets bored over and over. Because there is always someone saying in the gun forums they dont get why we shouldn't give in this one time.

That video also begs the question, what do members do as we approach the registration deadline? He said it himself that the processes being pursued may take months or years. OK, what do I do on February 18? I doubt the AMA is willing to take on the liability of recommending members break the "law." Will they provide counsel for a member caught noncompliant after the deadline? I really see NO WAY that the AMA can responsibly tell its membership to hold off on registration indefinitely. I seriously doubt we'll see that as official guidance after the deadline. It'll be interesting to see what's next as it's only about a month away.

I personally will just take the $5 on the chin, but folks who are looking for their last straw might jump ship. A truly gutsy move by AMA. Unless they know something we don't. But then, if they have confidence inspiring information, why the secrecy? Has a deal between AMA/FAA been struck and for legal purposes it has to remain confidential? Shrug.

That video begs more questions than it answers. It seem to be answering questions from two weeks ago, not today. They need an outpouring of information, not a trickle.

even if it was 1$ by giving that 1$ prematurely before it is LAW this action sways the courts in their favour.
