It’s the email controversy that won’t die for Hillary Clinton.

The former secretary of state has been hit with a racketeering lawsuit from Freedom Watch, a conservative group, that accuses her of failing to produce documents as required by the Freedom of Information Act, The Hill reports.

The suit was filed Wednesday in the U.S. District Court for the Southern District of Florida. It claims Clinton used private email in order to sell access to other officials, which in return got her donations for the Clinton Foundation.

From The Hill:

It alleges that, during her tenure, Clinton withheld documents requested under FOIA regarding State Department waivers given to businesses or individuals doing business with Iran, possibly undermining U.S.-imposed sanctions.The complaint, which lists Bill and Hillary Clinton and the Clinton Foundation as defendants, alleges the Clintons sold access to other U.S. government officials in return for donations to their organization, which they concealed, allegedly, by using a private computer server for her emails operated from their home in Chappaqua, New York.

The founder of Freedom Watch, Larry Klayman, alleges that the Clinton’s “systematically and continuously … conducted a corrupt enterprise” for more than 10 years. Klayman says the Clinton’s were in violation of the Racketeer Influenced and Corrupt Organization (RICO) Act, which focuses on abuse and misuse of businesses or organizations.

White House gets rid of FOIA regs, raising transparency questions

The White House, in a curiously timed move, is stripping a federal regulation that made a particular office subject to reporters' records requests.

The rule change means the Freedom of Information Act will no longer apply to the White House Office of Administration. In turn, the policy will allow the Obama White House to reject records requests for that office, just as the last Bush White House did.

According to the White House, the Obama administration has gone to great lengths to release more information on the front end. “From the day he took office, the President committed his Administration to work towards unprecedented openness in government," White House spokeswoman Brandi Hoffine said.

USA Today first reported on the regulation change, which comes as President Obama's former secretary of state, Hillary Clinton, faces her own transparency questions for using personal email while in that position. USA Today also noted that the decision comes on National Freedom of Information Day and during Sunshine Week, a movement by news organizations and watchdog groups to highlight issues of government transparency.

Most White House offices do not have to comply with FOIA requests for government records. For years, the Office of Administration was the exception. But that stopped during the George W. Bush administration -- and that decision is being followed by the Obama administration.

In the notice to be published Tuesday, the White House said it was not allowing a 30-day public comment period, and so the rule will be final.

Senate Republicans are renewing efforts to learn why Huma Abedin, a top assistant to then-Secretary of State Hillary Clinton, was allowed to keep working at the agency under a special, part-time status while also being employed at a politically-connected consulting firm.

The new requests are being made by Iowa GOP Sen. Chuck Grassley, chairman of the Senate Judiciary Committee, following revelations that both women used a private Internet server and email accounts for State Department correspondence.

Grassley says the earlier requests to the department have been largely ignored, so the new ones have gone to the department’s inspector general and to Secretary of State John Kerry, seeking their involvement.

Grassley’s probe started in 2013, when he requested all communications between Abedin, after she switched from a full-time deputy chief of staff for Clinton to a part-timer, then started working for Teneo, a consulting firm that says it “brings together the disciplines of government and public affairs.”

A July 2013 letter from the department to Grassley, provide by the senator’s office, states Abedin worked full-time from January 2009 to June 2012. It states Abedin did not list outside employment upon ending her full-time employment and that the department retained her as an adviser-expert at the hourly rate of a SGA GS-15/10.

The most recent available federal documents show the rate as $74.51 with a maximum pay of $155,000 annually.

“A number of conflict-of-interest concerns arise when a government employee is simultaneously being paid by a private company, especially when that company, Teneo,” Grassley said in the March 19 letter to Kerry that also raised concerns Abedin and other department employees appearing to have been “improperly categorized” as special government employees, or SGEs.

Grassley says he specifically wants to know “what steps the department took to ensure that … Abedin’s outside employment with a political-intelligence and corporate-advisory firm did not conflict with her simultaneous employment at the State Department.”

The letter to department Inspector General Steve Linick also questions whether the department’s “excessive” use of SGE designations undermines ethics standards an if Clinton and Abedin’s private emails have the potential to impede the department from fulfilling Freedom of Information Act, or FOIA, requests, over which the upper chamber’s Judiciary Committee has legislative jurisdiction.

Grassley says the department’s answers have so far been “largely unresponsive” and points to a November 2014 department response that in part states “an individual may receive an SGE designation if he or she is joining the department from the private sector or is coming from another government position.”

However, Abedin came neither from the private sector nor another government position, Grassley argues.

“She converted from a full-time employee … with seemingly little difference in her job description or responsibilities,” he wrote.

Grassley also argues that the purpose of the SGE program is to help the government get temporary services from people with special knowledge and skills whose principal employment is outside the government.

However, Abedin essentially kept the same job and was subsequently hired by Teneo and the Clinton Global Initiative.

“It is unclear what special knowledge or skills Ms. Abedin possessed that the government could not have easily obtained otherwise from regular government employees,” Grassley wrote.

The State Department says Abedin was an SGE until February 2013, essentially doing the same job that she did as a full-time employee, advising on Clinton’s schedule and travel. It also states she reviewed department ethics guidelines but was allows to work part-time without a new security clearance.

Grassley also says the department’s current use of the SGE designation “blurs the line between public and private sector employees” and that department employees getting full-time salaries for what appears to be part-time work is “especially troubling.”

“The taxpayer deserves to know,” Grassley wrote.

Hillary Clinton's chief of staff at the State Department was listed as a director at the Clinton Foundation
in its corporate records for more than three years after joining the administration, highlighting concerns that Clinton's aides were too close to the foundation during her tenure.

The "William J. Clinton Foundation Corporation" named Cheryl Mills as one its three directors when it applied for nonprofit corporate status in Florida in June 2009-five months after Mills began serving as Clinton's chief of staff and counsel at the State Department.

The organization continued to list Mills as a director in its annual state filings in 2010, 2011, and 2012. During this time, the foundation updated its office address and registered agent on the same documents. Chelsea Clinton replaced Mills in the March 2013 report.

The Florida filings highlight the cozy relationship between Clinton's inner circle at the State Department and the Clinton Foundation, which has come under scrutiny from watchdog groups for accepting money from foreign governments and donors.

Huma Abedin, another close Clinton aide, received a waiver in 2012 that allowed her to do part-time consulting for the foundation while working for the government.
She did not publicly acknowledge the work until it was revealed by the New York Times.

This sounds familiar. Which other politicians have tried to avoid email disclosure?

Recent history has been full of colorful examples of politicians and public officials attempting to shield their personal emails from the public. Here are just a few.

The George W. Bush administration: As Max Fisher writes, George W. Bush's second presidential term was marked by controversies over email records.
John Kitzhaber: The scandal-plagued Democratic governor of Oregon "requested state officials destroy thousands of records in the governor's personal email accounts" — a request those officials refused to carry out, reported Nigel Jaquiss of the Willamette Week.
Mitt Romney: In 2007, the outgoing governor of Massachusetts "had emails and other electronic communications... wiped from state servers," according to Mark Hosenball of Reuters.
Scott Walker: While Milwaukee County Executive, Walker and his aides used what the Milwaukee Journal Sentinel called "a secret email system" to "avoid public scrutiny" — and to allow his government staff to communicate about his campaign during working hours. Indeed, they even set up a new router in the office to help them do so.
Additionally, there are the many missing emails from former IRS official Lois Lerner , purportedly lost in a hard-drive crash, which many members of Congress are still quite curious about. An inspector general looking into the matter recently said there was "potential criminal activity" around the emails.
