Female justices issue searing dissent over new contraceptive case

The fierce disagreements dividing the Supreme Court over this week’s Hobby Lobby decision were laid bare Thursday in a searing dissent from Justice Sonia Sotomayor, who said the justices’ decision in a separate contraceptive case “undermines confidence in this institution.” The dissent was signed by all three female justices. 

“Those who are bound by our decisions usually believe they can take us at our word,” wrote Sotomayor. “Not so today.”

The dissent was in an order to grant an emergency request from Wheaton College, an evangelical college in Illinois, on a temporary basis until its appeal goes forward. At issue is the “accommodation” the Obama administration worked out for religiously-identified non-profits: Sign a form certifying your objection, and the insurer will provide the coverage directly, without the objecting organization having to pay. As of now, 122 non-profits have sued, claiming that signing the opt-out form for someone to get contraception violates their religious liberty. (An attorney for the plaintiffs has repeatedly referred to it as a “permission slip for abortion,” even though it does not actually cover abortion.) 

In fact, that accommodation was one of the reasons Justice Samuel Alito cited to justify his Hobby Lobby decision – words Sotomayor threw back at him in the dissent. Under the Religious Freedom Restoration Act, the government has to show it has pursued the least restrictive means to accomplish its goal. Alito claimed that because the nonprofit accommodation exists, that means the government has other ways to get women access to contraception that respects religious liberty. Yet only a few days later, he ruled that the nonprofit accommodation – again, signing a form – is also a violation of religious liberty.

“Let me be absolutely clear: I do not doubt that Wheaton genuinely believes that signing the self-certification form is contrary to its religious beliefs,” Sotomayor wrote. “But thinking one’s religious beliefs are substantially burdened … does not make it so.” She added, “Not every sincerely felt ‘burden’ is a ‘substantial’ one, and it is for courts, not litigants, to identify which are.” 

What the plaintiffs in the nonprofit cases are seeking is to be treated like churches – no contraception for anyone. But the majority claims that “nothing in this interim order affects the ability of the applicant’s employees and students to obtain, without cost, the full range of FDA approved contraceptives,” because the government already knows about their objection from the lawsuit and can tell the insurer itself. But without the form, Sotomayor argues, how could the administration “ever identify the organizations eligible for the accommodation and perform the administrative tasks necessary to make the accommodation work?”  

She added, “The Court’s actions in this case create unnecessary costs and layers of bureaucracy, and they ignore a simple truth: The Government must be allowed to handle the basic tasks of public administration in a manner that comports with common sense.” 

Sotomayor also pointed out that the facts of the case hardly met the Court’s high standard for such an emergency injunction. The dissent was co-signed by Justice Ruth Bader Ginsburg and Justice Elena Kagan, but not Justice Stephen Breyer, who also dissented with them in Hobby Lobby.

How ab out the common sense truth that the SCOTUS decision has nothing to do with contraception?

But rather abortion.

Those female justices are screamin meemy lefties and wish everyone else to pay for abortions other than the person getting one.

Republican justices interpret laws from a conservative point of view.

It don't work like that all the time. But, generally thats the way it works.

In other words, if you view life from lefty rose colored glasses, drink to much rancid smelling kool aid and whenever conservatives have a majority on SCOTUS you are going to be severely disappointed whenever SCOTUS rules on important issues of the day.

Forget Hobby Lobby - This is the Real Scandal

As you've probably noticed, the airwaves and news pages have been filled with liberals deliberately lying about the meaning of the Supreme Court's Hobby Lobby decision (Conservatives want to deny women birth control, Republicans are trying to stop women from having sex, yadda yadda yadda).

For the truth, let's go to Professor Eric Posner at the Chicago University Law School, who sums up the Hobby Lobby decision much more accurately than the liberals calling it a "war on women":

"The Religious Freedom Restoration Act says that the federal government may not put substantial burdens on religious exercise. The Affordable Care Act, as implemented by some federal regulations, required Hobby Lobby to include contraception in its employee health insurance plan. Hobby Lobby covered most forms of contraception, but not four that it believed amounted to abortion, which violates the religious beliefs of Hobby Lobby's owners. If Hobby Lobby doesn't comply with the regulations, it must pay taxes and penalties. So the question before the court boils down to whether those taxes and penalties substantially burden Hobby Lobby. The majority, in an opinion written by Justice Samuel Alito, said yes."


Meanwhile, a true scandal is happening that should concern all Americans, regardless of party affiliation or level of accepting the federal government's role in controlling your life.

Our President has been found guilty of subverting the Constitution, which he swore to uphold, and is publicly planning to do it again and again and again.

No matter your opinion on amnesty for illegal immigrants, a church's right to make personnel decisions, or the ideology of National Labor Relations Board appointees, one of the principles upon which our country was founded is negotiation and compromise between disagreeing parties. Simply because one party seeks more compromise than the other party is willing to give does not give the President the right to subvert the process.

This is why the Supreme Court unanimously determined President Obama has violated his oath to uphold the Constitution... twice!

This is why John Boehner is suing President Obama.

Well, that and Boehner's attempt to pretend he isn't a weak-kneed beltway insider.

The President's "go it alone" ideology has been rebuked not only by conservative justices who believe their decisions must conform to the original intent of the writers of the Constitution, but also the liberal justices, including two appointed by Obama himself.

This has not stopped him for a second.

President Obamaa threatened to use executive orders to create his own immigration laws unilaterally.

"America cannot wait forever for [Congress] to act. That's why today I am beginning a new effort to fix as much of our immigration system as I can on my own, without Congress," Obama said on June 30th in the Rose Garden.

When asked about consequences of the President's threat to evade the lack of congressional legislation with executive orders , White House Press Secretary Josh Earnest laughed and replied, "What that they might sue?"

"They announced they were doing that last week. So, the prospect that Republicans might do even more to try to obstruct the president's agenda I think is a little far-fetched. It seems to me they have tried every single thing they can think of already to block progress for this country so the fact that they might do more is not something we spend that much time worrying about."

For you liberals, imagine President George W. Bush cutting taxes on the wealthy and bombing Iran and droning civilians by executive order.

Wait... that droning part is being done... by Obama... scratch that.

The President's Dream Act is encouraging poverty-stricken parents in South and Central America to ship their children to the border of The United States where they know our hearts and arms open to them. Thus it would be cruel not to accept the parents of these children, too, right?

The cruelty is Nancy Pelosi's photo-op encouraging people to abandon their children at the border.

Strong borders and keeping the promise of returning the children to their parents would help end this human tragedy.

Instead, President Obama blames Republicans and refuses to compromise

Obama is just another two bit lawyer that thinks he is above the law. He should be impeached for these transgressions. A President that doesn't follow and uphold the law is the worst enemy the United States could possibly have and isn't fit to hold the office!
