South Carolina legislators are looking to eliminate Obamacare in their state under State House bill H 3101, the Daily Caller reported on Monday.

The bill is titled the “South Carolina Freedom of Health Care Protection Act,” and was passed the state House of Representatives last April by a 65-34 vote.

The Daily Caller reported that the bill now heads to the South Carolina State Senate that is controlled by Republicans, is setting up the likelihood that South Carolina will become the first state to exempt citizens and businesses from all participation in the Affordable Care Act.

The legislation summary reads:

“A bill to amend the code of laws of South Carolina, 1976, so as to enact the “SOUTH CAROLINA FREEDOM OF HEALTH CARE PROTECTION ACT” by adding Article 21 to Chapter 71, TITLE 38, so as to render null and void certain unconstitutional laws enacted by the Congress of the United States taking control over the health insurance industry and mandating that individuals purchase health insurance under threat of penalty; to prohibit certain individuals from enforcing or attempting to enforce such unconstitutional laws; and to establish criminal penalties and civil liability for violating this article.”

South Carolina’s Republican State Sen. Tom Davis, sponsor of the bill told the Daily Caller, “The proposed legislation renders the Affordable Care Act void or inoperable through a handful of provisions.”

“It will essentially have five components to it, all of which in my judgment are legal, effective, and within the state’s power to do.”

“This provision, Davis told the Daily Caller, comes from the anti-commandeering doctrine established in case law that says feds can’t compel states to enforce federal laws.”

“Congress can pass laws, but it cannot compel the states to utilize either their treasury or personnel to implement those federal laws.”

Making matters worse, David said a few hours ago, “IRS says volunteer firefighters are "employees," and thus subject to the Obamacare mandate. This is an assault on the voluntary associations that Alexis de Tocqueville identified as the chief strength of America back in the 1830s, and must not be allowed to stand. Statists despise what what Edmund Burke called "little platoons," that is, the local groups and organizations that provide our lives with structure. They vex Leviathan.”

“Note to intellectually lazy and incurious statists – the word "nullification" does not appear one time in this piece, nor will it appear in the legislation I will introduce and argue in the State Senate in January, so get some new talking points.”

Will other states follow suit? No one is sure but with the multiple lawsuits, and millions of consumers losing their present health care insurance, South Carolina’s House bill may set the tone for other states to follow suit under state’s rights.

Sounds as if this "monster" will have to stopped at the grass roots level being congress won't help the American people.

Pass this thing SC and show the other states how to do it.

Sounds as if this "monster" will have to stopped at the grass roots level being congress won't help the American people.
I have said for a long time that our only chance against a fed government like this is states rights and the Tea Party.

If the fed government refuses to enforce its own laws, then they cannot force the states to to enforce its laws.

Neither political party in Washington DC is looking out for its own citizens across the USA. So, to he'll with them.

I have said for a long time that our only chance against a fed government like this is states rights and the Tea Party.

If the fed government refuses to enforce its own laws, then they cannot force the states to to enforce its laws.

Neither political party in Washington DC is looking out for its own citizens across the USA. So, to he'll with them.

South Carolina is about to put their proverbial foot down on the arms of the Federal govt overreaching their authority to regulate the states citizens.

If it passes they saying that they are willing to fight the feds and will not go quietly.

Singapore is a VERY stable first world country.
Like individual people, societies have their own breaking points. They build up anger and frustration for years… sometimes decades. Then all it takes is one spark. One catalyst. And it all becomes unglued.

Dennis just curious, we had a debate back in the 2012 primaries about voting for a third candidate.

If a RHINO like Romney is the Republican nominee, and the Tea Party person is conned out of the running again (through the pervasive tactics of the republican party), will you vote for the Republican Nominee or would you cast your vote for the third party?
Thats a fair question. Back then, there was no way I would support a third party candidate because that just scoop the democrat nominee right into office.

I still feel strongly that is that case today. But, we are getting closer to a third party taking over. Just not yet.

If the repubs loose the house and senate in a big way in 2014 and the dems move forward on ObummerCare in full force, we could easily see a third party move into the forefront in 2016. That would mean millions upon millions would be getting their take home pay reduced significantly because of ObummerCare and increasing taxation/regulation. Thats a ripe time for a third party.

1st of all we're not Singapore 2nd if the state cant prove a point
beyond reasonable doubt as to or how they're being subjected to any latency by the FED then they'll come on the loosing end.

Take a look at the wall street movement wasn't the people come out
against bureaucracy and other big money firm interfere with government
that write off there voice off?? now how did this all went?? I hope you seen the end result.

The Singapore example a reference point. A revolution can happen here and will.

Reasonable doubt is for trial, not for judicial cases. And I think you should look up the definition of latency before you use it in a sentence again.

Wall street was a bunch of jobless weaklings that had no backbone to make any real changes. While I agree with their some of their messages (Too big to fail banks should be broken up), they had wrongheaded thinking about why they were there.

Societies do not revolt until they have been pushed into a corner and are about to be slaughtered. (Or they have nothing to lose)
