Rumors about patent issue. NOT TRUE
Hey guys, I asked the company about this after seeing the rumors on the forums and concern of alot of people that these rumors might be true. They are not true. Here is the response I was sent:

Dear Tom,

As answer to your question about patent issues here's the answer to the info you requested and to the claims you forwarded us:

There is no issue whatsoever related to any patent of any kind.
We actually find pretty funny how people come up with "rumors" when as you know from your own experience we don't share information with anyone of any kind whatsoever not even with team pilots precisely because the leak of the existence of the Aurora six years ago before it was time to be revealed was done by a member of the team at the time.

Based on that fact anyone that says that there are "rumors" of any kind is simply lying and creating the rumors themselves in a sad effort to make themselves seem "important" or "in the know" about something like the release of a model helicopter. The reality is that absolutely nobody including personal friends of the owner gets any information that is in any way different than the information we release publicly.

At this time we have been doing a review to ascertain where we are and at this point in time the only thing we're missing is to receive back some parts that are being processed by third party companies that are providing services to us. Once those are received which we expect will be pretty soon the kits will ship and all this rumors will look as much nonsense to anyone as as they are to us.

Just don't forget to make note of who are the sources that are coming up with the rumors so next time the same sources talk about rumors you will have some history on the "reliability" of the source.

Regarding the claims about patents and all of that nonsense:

Members of our company have a lot of experience in the patent field due to frequent use in other fields that the members are involved in. Unlike people that talk about patents we actually have members that have gone through the process several times so we talk from experience and from paying intellectual property lawyers that have taught us exactly how patents work which is very different to what the majority of people think what a patent is and how they are awarded.

As a way to illustrate how far things are from reality here's a few points:
Utility patents protect inventions that are a novel, nonobvious, and useful.

Original and Nonobvious: An invention involves an invention that when compared with what is already known, it would not be obvious to have been replicated by someone with a good knowledge and experience of the subject. For example as the one you mentioned about the gears between plates. If you use gears between parallel plates as you mentioned to us the simple existence of a common mechanical watch negates the novelty of that claim making it obvious since any watch has gears between metal plates. In addition to that if there has been any similar use of a concept anywhere before such as in a similar models as it's in the case in our industry the claim is immediately invalidated by being in not only a similar but the exact same field.

Additionally about one of the things you mentioned to us, there is no such thing as an "international patent". A patent is awarded by the government of a country and is valid only within its territorial boundaries. To obtain a patent that is valid in a particular country, a request must be made in that specific country's patent office. You can read more about it here.

A large portion of intellectual property lawyers are litigating lawyers who make money countersuing bogus patent claims so people are very careful when claiming intellectual property rights due to the liability that such claims imply.

Anyone can file a patent application for anything. As a matter of fact you can file a patent for the iPhone if you want but it's very unlikely that a patent will be awarded to you. Nevertheless it will allow you to claim something as stupid as the fact that you have a patent pending for the iPhone which being itself stupid would still be true. More than 95% of the applications are rejected and even of the 5% that are awarded the great majority of the ones that are challenged are also invalidated. So a very small number of patents are ever good and real inventions deserving a patent.

The rumor mills and the conspiracy theorists always do that in every release of every brand of every industry and the internet has only amplified that nonsense. They live an imaginary Agent 007 life in their minds and think that the real world is ruled by Hollywood scripts and not reality. To their dismay the world is not a Hollywood script and the all things have real reasons and explanations that are usually very mundane, simple and lacking the secret agent excitement they wish they had.

At the end of the day what matters is that if you have a pre-order with one of our dealers you will be receiving a real kit in a short while and all the conspiracy theorists will simply move to the next target because that's their real hobby.

Avant RC.

So as you can see this is simply a rumor and nothing more.

Speaking of patent infridgement ...

I was in Manhattan last week and while walking by Sak's Fifth Avenue I spotted something interesting right there next to a Yeti in the window. Looking closer I noticed they ripped off the Mostro tranny ...

I asked a varietey of questions in regards to posts i was seeing on the forums and they took time to answer them. Simply saying "no" would not have answered alot of the questions I have seen asked on different forums.
