Oh god....I never thought of that. BUT....it will never happen with a Rep house.
That's why 2014 elections are pretty much a do or die election for this country.
If we get Dem majority in both houses, can you even imagine what they'll do???

Executive privilege

In the United States government, executive privilege is the power claimed by the President of the United States and other members of the executive branch to resist certain subpoenas and other interventions by the legislative and judicial branches of government. The concept of executive privilege is not mentioned explicitly in the United States Constitution, but the Supreme Court of the United States ruled it to be an element of the separation of powers doctrine, and/or derived from the supremacy of executive branch in its own area of Constitutional activity.[1]

The Supreme Court confirmed the legitimacy of this doctrine in United States v. Nixon, but only to the extent of confirming that there is a qualified privilege. Once invoked, a presumption of privilege is established, requiring the Prosecutor to make a "sufficient showing" that the "Presidential material" is "essential to the justice of the case" (418 U.S. at 713-14). Chief Justice Burger further stated that executive privilege would most effectively apply when the oversight of the executive would impair that branch's national security concerns.

Historically, the uses of executive privilege underscore the untested nature of the doctrine, since Presidents have generally sidestepped open confrontations with the United States Congress and the courts over the issue by first asserting the privilege, then producing some of the documents requested on an assertedly voluntary basis.

Well, according to the definitions of "Executive Privilege" shown, I could find no place where that privilege by the prez gives him powers to create laws. It does appear to give him power to protect the executive branch of government against unwanted disclosures claimed by the legislative branch of government. As Nixon discovered, sparingly.

Executive Orders

The president's executive powers also include the authority to issue proclamations and executive orders. A proclamation is the president's official announcement that the president is taking a particular action. Such an announcement is not the same as an Executive Order, which has the force and effect of law by carrying out a provision of the Constitution, a federal statute, or a treaty. The Constitution does not expressly give the president the power to promulgate executive orders. Instead, this power has been inferred from the president's obligation to faithfully execute the laws. Proclamations and executive orders are published in the Federal Register to notify the country of presidential actions.

The two words : That have recently been used are either "

"special" 0r "extraordinary" + { Executive Privilege }

It's a modification of some sort - In Legal Description

It went thru on some vote attached to a Bill last week almost as a Ear Mark and it was only mentioned twice.

Once on the UP Crawler and Faux mentioned it once then it went under the blanket.

If the Federal Registry : The only place you can read them IF it is up to date ----it should be posted their and pretty current. One of them at the top : Their dated - then you get to follow a few tree's or additional attachment's.

Let's hope the hound's of heaven chase it down - We got three year's to go PLUS the last four---- then maybe a self induced extension ??

Believe it has only been in acted one other time -to extend a term.
