The article say's he was repeatably told to put down his assault rifle ? Why didn't he ?? was he a Fruit? or a Nut ?? or just deaf and couldn't follow direction's ??

Should question the Parent's, if he has both, and ask if they raised a i-dot

Do you not remember being 13? We all did many stupid things! Could have fired a bean bag first or a warning shot....there are many ways to handle this situation. I am simply not going to give police a pass on this situation!

The kid was out numbered by police. Come on man!

What I would like to know is if the kid displayed some kind of threatening behavior. Every news article I found related to this doesn't mention anything about the kids behavior, which leads me to believe he wasn't acting in a threatening manor. Why the hell did they shoot without trying to approach the kid! This is the third shooting of nonthreatening people this year in that county of Commifornia!

I'm not giving the Police a pass on this one but the kid doesn't get a pass either. Heck, I knew at 5 years old (and that was a long time ago) that you don't point toy guns at police. This is (should be) basic common sense and someone who is 13 should know what is right and what is wrong in that type of situation.

Another thing is, maybe the kid was like so many other teenagers and had his Ipod plugged into his ears at full volume and was just completely oblivious about what was about to happen. There are quite a few articles about it, and some go into more detail, but none state anything about the kids attitude.

It doesn't state anywhere if he did or didn't point it at them. The only sure thing is that they told him to drop the gun several times, and they shot him.

Very sad and unfortunate. But, from the police stand point, they did not know the child's age and they did not know if the weapon was real or not. In situations like that, you have to assume the weapon is real and that the assailant has every intention to use it.

However, without knowing the perpetrator's state of mind or even if their commands were understood, they should not have used deadly force as a first line of action...especially if the kid wasn't acting in a threatening manner. He probably froze and was confused with all the officers screaming at him..not a good reason to shoot him.

Bean bags hurt like hell and tazers just plain suck to get hit with. Worse case, you get some welps or pee your pants, but you live and the cops don't go home knowing they killed someone's unarmed child.

Honestly, I don't know how I would have reacted in high pressure situation like that. Everyone is on edge with all these random shootings happening around the country. I'd like think I'd be able to critically think, but who really knows? The officers involved should resigne; this is one mistake that can't be undone and public trust is lost. If I'd done something like this as a military member, I'd be locked away in Leavenworth for a very long time. The police should be no different.

I agree with Lady Magic, but, there is a HUGE amount of information missing from that article. In reality, the boys age really has nothing to do with wether he was carrying a real or toy rifle. If it was a toy rifle, I CAN'T BELIEVE that the officers would still shoot if it had a red muzzle break at the end of the barrel, like most toy rifles and pistols do. Also, if it didn't, did he point it at the officers? There is SO MUCH MISSING that it is impossible to really say anything else than what a tragidy!

So you're saying if I carry my gun on me as I normally do when and where it is legal to do so, police have a right to shoot me because I have it on me yet show no signs of aggressive behavior nor any other danger. Bullspit! I as a citizen and a parent still am able to protect my family and myself, but if a guy is knocking on my door I can not just assume he is a threat to my family or myslef and shoot him. Now if the guy kicks the door and forces his way into my home, I will do what I need to do. Police are held to an even higher standard, even if someone shows threatening behavior, they need to attempt non lethal methods if possible. Don't give me that crap that because they are cops, they can do what they want. You have been brain washed living in a communist state for too long!
