I agree Erich.

We should all reach out to him and express our gratitude.

My guess is that document took upward of a year to produce and several paralegals busting their butts.

Just finished reading it myself.

I have stated (obviously not quite as elegantly or legalized) much the same things, not that my opinion makes a $hit to the FAA, but when you read into the actual FAR's, it's very plain that they simply do not apply.

I was not aware of a lot of the internal requirements of the FAA as pointed out in the Dismissal, nor of the fact that "interpretation policies" are not binding to the public.

Will be eagerly watching the outcome of this...

And for those that have read the motion, it's very clear that this could ultimately affect not just commercial AP work but also commercial r/c heli flying.

Commercial r/c heli flying? Yes.

Pilots that get paid to say they really like a product and get paid to represent said companies by doing demos and or competing could be affected as well.

Since pilots are paid for winning competitions and these are for profit events, this is considered "commercial use".

So for those that may dislike Trappy, he sure came out swinging.

Do anybody know how much the lawyer charge in this case for his job?

My best guess for this motion would be $20k.

The endless research that went into this documents likely kept paralegals busy all hours of the night for months on end.

But if you've got FU money than who cares.

Better than paying $10k and admitting being wrong.

Money well spent IMHO.

am i the only one that finds it sub optimal to rub the legislators nose into the fact that they didn`t make restrictive legislation YET!?

He might get the thing dismissed but i`m thinking it`s a pretty safe bet that right after there will be a flurry of acivity from the FAA, to make waterproof definitions, and restrictive legislation on the certification and operation of RC as well as comercial UAS.

Well in 60 years the FAA has never regulated model aircraft. With AMA and all of it's lobbying I can't imagine they would start now with even less money and resources available to them at this point.

As we know, and have known for some time (except those that have had their head in the sand) that regulations ARE coming, I think it's a moot point.

The FAA, just like ALL gov't agencies, have to follow the rules, follow the Law. Which includes their OWN rules for coming up with new regulations. Arbitrarily coming up with new regs every other day just isn't how it's done, whether some like it or not.

If I remember, last year Congress gave the FAA the authority to come up with regs for UAVs. And there was something in the law regarding exemptions for hobbyists. Perhaps someone else who is more knowlegdeable about this can chime in.

It could light a fire for them, however to actually get something into law is still years away.
