California and some other states finally make a smart new law
As of the first of the year it is now illegal to protest an hour before and an hour after any funeral.

Yes they're despicable.....but the law will be found unconstitutional. Free Speech is Free Speech is Free Speech.....

You cant pick and choose from the Constitution to suit your needs.....you have to take the good with the bad. You want 2nd Amendment rights.....you gotta take the 1st Amendment for what it is.....

Possibly.

But, seems to me this also could be argued as a public safety issue because of the extremely inflammatory speech at the most despicable time. That is very confrontational and potentially dangerous for all involved on both sides.

In addition, they actually did not take away their right to free speech. They did restrict "When" they could do it.

The public safety argument in addition to the issue of "When" free speech can be spoken in favor of public safety argument could win over on this matter.

Just my 2 taxable cents.

Free Speech is Free Speech is Free Speech.....
Free speech is an individual right, not a group right. One person can probably be there with their signs but they will not be able to gather as a group without the proper permits. Which will be never given out.

fake religious church group of hate.
Supposedly that is just their gimmick but they are actually exploiting civil rights law. They exist to inflame and then file lawsuits the instant someone violates their civil rights. They are a family of attorneys so they know exactly where the lines are. They may be able to turn the California law into a gift to themselves. Fred Phelps is a disbarred civil rights attorney. He probably has an axe to grind and just enjoys making a mockery of the system that kicked him out.

I dont care for what wbc does as far as this goes but they do have the right to assemble/protest, at least on public lands. I dont think many cemetaries would qualify as public land though.

These freaks have been around for several years setting a precedence of hate, confrontation, and intimidation. Their style of protest is widely known to take place at funerals of dead soldiers and their families.

Why someone has not prosecuted those people for hate crimes shows the lack if balls of our own political leadership. Their so called protests are not protests. They are expositions of hate and go far beyond any right to free speech.

Although we do have both state and federal governments that live for political correctness, it's a small bit of assurance that at least someone somewhere in government is willing to take a stand for the innocent.

People do have a right to assemble. But, people do not have a right to promote hate, confrontation or intimidation. Period.

The amendment specifically references the right to peaceable assembly, although the "peaceable" part is where the stretch exists.

I hate that group but they have a strong case on their hands and obviously the hate and experience to challenge for quite some time.
