I forgot that I was in the hair splitting forum I used "public" in the sense of an area that is readily accessible to members of the population at large. This is as opposed to an area that is private, or of limited access.

Notice I did not say public property, which is different from private property. You can indeed have a publicly accessible place on private property.

This is different from government owned property, which is the sense of public that you are confused about. Certain types of government owned property can be designated for public use, hence the term public property.

So, in the interest of exacting precision in my language, allow me to restate the portion of my post which you have taken issue with.

This incident took place in a mall open to the public but which is on provate property. This is completely different from the situation of it taking place on government owned land designated as public use, i.e. a park, etc.

But none of this changes the main point. It did not take place on government owned or operated property, which is the key to whether or not these types of expression can take place.

Excuse me, you said the Constitution protects people and allows them to assemble. True, but it does NOT allow/protect people to assemble on PRIVATE property, regardless if it has "public" space.

My point is the mall is private property and you can not suggest that the Constitution will protect those people.

well, if you are going to split hairs, some states expand public rights on private propery, and there are definitely constitutional protections and guarantee afforded to the public when dealing with owners of private land who provide access to the public, which would certainly include a mall.

I really do however, think you believe all of this. Keep on believing and before you know it, Christianity will be outlawed. Then everyone can huddle in dark buildings, whispering prayers, all the while being fearful that 'big brother' will hear them....this is how it begins.
