1 yes...show up.
2 your wife...from what I understand "She" was not legally served due to the name being wrong. Have her stay home. When the judge asks where your wife is, answer "she is not involved in this". Of course the name will be brought up...your response "I don't know who this person is". Doubtfull there would be a warrant.

Counter sue...yes. Keeps her from leaving the suit.

how about harassment for the attorney...get a Grievance filed. Yea, I know...still, the attorney has to answer it.

So did the Judge laugh at her?

I seriously doubt that. Most States have no money and are too busy paying interest to lock people up over stuff like this. Hell my state does not even lock up pedophiles unless they seriously violate probation!!Proud to have over 13 pages of Good Guy feedback.

Sorry for the late response, I have been busy.

All I can say is WOW.

I was there with my wife 20 min. before the hearing. The lady isn't there yet. We check in with the secretary. 10 min. til our hearing, no lady, 5 min. no lady. Time of Court date, I go into courtroom, Judge small talks with us. 10 min. passes no lady. Judge say's "CASE DISMISSED".

I LOL, get my paperwork, and leave. Me and my wife get into the car, and as soon as we get onto the highway guess what we see???? The lady w/ 2 other guys in her blazer. She looks at me, with her face dropped down to the floor boards!!!! She had the WTF look!!

I don't know what else happened after. She was pulling into the Magistrate's office, as seen in my rear view mirror.

yeeup, you got to respect the judge and the Court or your going down, as she did, good for you,,
now if she keeps at you offer her $50 to shut her up, if she says no and she takes you to court again you can use that offer in court against her

Not if the Judge dismissed with prejudice. If so, and very likely the Judge did just that, the Plaintiff has zero recourse.

lol. why would he do that. on what grounds? A proceeding never happened. Dismiss w/ prejudice has to be for a reason, what motions did defendant make regarding grounds for permanent dismissal?

Unfortunately this is how the legal system works, everyone gets their day in court, and not showing up does NOT deny you your day in court.

Sounds like op has already done his homework and knows she can refile with a different judge.
Not if the Judge dismissed with prejudice. If so, and very likely the Judge did just that, the Plaintiff has zero recourse.
