Just telling someone to "stay right there" is Not considered kidnapping
He also said "I'm not letting him go anywhere". Replace "him" with "her", and you have the exact scenario that sent one of my friends to prison for 9 years. So, don't tell me that it's not considered kidnapping, when it clearly is.

you have the exact scenario that sent one of my friends to prison for 9 years. So, don't tell me that it's not considered kidnapping, when it clearly is.
I would bet there is a LOT more to that story then you saying, what the guy in the truck did was no crime. He didn't touch the guy, if he had, or if he had threatened vilonce against him if he moved, And if the camera guy was in fear of his life, then yes, it could be considered kidnapping.
Big differance between him and your kidnapping buddy.

I would bet there is a LOT more to that story then you saying
There were three kids throwing rocks at cars. One was a 19 year old girl. She threw a rock at his car. It destroyed the windshield. He stopped, and told her not to move. She sat on the curb. The boys ran. He went to the nearest house and asked them to call the police. Then, the boys returned and started threatening him. One of them lunged at him. He knocked the kid to the ground and found himself in a fight with both of them. The girl got up, he told her to sit back down. She did. After knocking one of the boys out cold, the other ran away.

He was charged with assault, battery and kidnapping. The assault and battery charges were dropped in court. The kidnapping charge stuck, it was a 10 year sentence. He would have been out in 4. But, he got in a fight that eliminated the possibility of getting out early.

Harassment and assault are both crimes. But, unless charges are filed. There is nothing the law will do.

It probably depends on location as to how that gets enforced. But stupid laws can still hit you as hard as intelligent laws. It pays to be up on them. If you take a CCW class or other class that touches on the use of force then you can learn some important nuances. I am positive that for us to have sympathy for the guy in white would not protect him from assault charges in court. The only reason this is worth arguing about is so kids reading this don't get the impression they can behave like the guy in white. I guess to boil it down: two wrongs don't make a right. Even if you consider it a crime for a reporter to be walking beside your car after you just did your damnedest to make news.

I have to laugh when I see a video like that. So clueless!

I trained the real-deal in Shotokan Karate, earning my Shodan (1st Degree Black Belt) after an almost 5 year journey of discovery and learning. Anyone that studies and trains in such a discipline realizes that the fighting is the least of it.

1st Place, I thank you for starting my morning off with such a good laugh! I bow to your Ninja skills and will do all I can to avoid your "Judi" chop. Now, if you want to swing a "pork" chop my way, I could use something for lunch!

As for news crews, a couple of years ago I came home to fine a Fox News truck blocking my street and driveway with a reporter doing an on-camera piece right in the middle of the road. I stopped, got out of my vehicle, and in a break asked what they were doing. Turns out they were doing a piece on registered sex offenders and there was a Level 3 living just two houses away! (My wife and I didn't even know!) I asked them if they could move their truck so I could get in my driveway. They stepped aside, the driver backed the truck up about 15 feet, I entered my driveway, and they repositioned themselves and continued the filming. Yes, a slight delay, but over-all no fuss at all.

After viewing the video clip at the head of this thread, I think both sides handled the situation badly. But that is just human nature. And that whole ballon boy thing must be such a nightmare not only for the family but for the neighbors, too.

Maybe the whole system needs to be rethinkined. We live in a society where short scrawny men can be powerful. They hide behind laws and rules and use their wealth and other status for power. Maybe we should go back to a more primal nature. For example, the camera man and the driver should fight just like lions and other animals do until one is dead or gives up. The stronger man would win and the winner could then claim the rights to the losers wife and mate with her.
