bad bad cop
So there I was on Sun driving home from a birthday party with my family, having a conversation with my wife. When I look in the rear view and there is a car ridding my back bumper so close I can't tell what kind of car it is. There is a car next to me so I can't move over. I look again and notice it's a highway patrol so I speed up to move over. Before I can move over, he moves to the right lane and begins to pass me. When he get's next to my car he looks over at me slams on his brakes get behind me again and pulls me over. From the moment I rolled down my window he was very rude to me, I already had my liscence and proff of insurance out and ready but my wife was looking for the registration in the glovebox..This pissed him off even more. I gave him all of the stuff he never told me why he pulled me over then he walked back to his car. He had me there for 30 min. By which time it began to rain. He then made me get out of my car (in the rain) to walk over to his car while he explained to me that I had a record riddled with speeding tickets (3 ticket in 13 years none of which were recent). So to make a long story short he hands me a ticket for 70mph in a 60 and a seatbelt violation (grand total $260.) I expressed my frustration to him and mentioned #1 I only sped up to move out of the way.. #2 I can ride a motocycle in FLa with no helmet all day but I have to wear my seatbelt? So then goes off and starts telling me he's going to take me to jail If I don't shut up..JAil for a 10 mph speeding ticket? I didn't yell, scream or insult him at any time. Regardless I just shut up took my tickets and got out of there..

I can accept the tickets I was not wearing my seatbelt (I never do)and I did speed up.. But being degraded and bullied around and made to stand out in the rain.. That's just wrong..I even think it had something to do with race (since he didn't decide to pull me over until he actually saw my face)I hate to think it, but I get that feeling..

I know there are a million good cops out there and appreciate evry single one who puts there life on the line.

I just think this guy was abusing his authority to degrade me in front of my family. Is there anything I can do? If i file a complaint, I'll probably get tickets left and right. Should I just let it go?

Is there anything I can do?
Wear your seatbelt for starters.

It sounds like you had a run in with a cop having a bad day. However, it appears that he was looking for someone to pull over and you gave him just enough to do so by going beltless.

He more than likely would have passed you by and moved on had you been wearing your belt. They are getting really serious about belt enforcement. They do save lives.

fwiw...

Another case of some one having authority that should nerver be allowed to have it...Only reason somone goes after positions like that is that they have issues with control, and hence insecurity...That insecurity drive the bullying behaviour, and there you go...
My advice...Fight the ticket..Even if you lose, it screws up the scam the state has going, and costs the govt. money. It will also keep this moron off the street for a day...

Tough call... It will be more expensive (time off work) to go to court than to just pay the tickets. Out of principal, I would not accept the speeding ticket. But, I would pay the seat belt ticket.

Unless the cop had you on radar, he has no proof that you were speeding. He's luccky you didn't brake test him. He is on a power trip and needs to understand that he can't treat people like that!

If it were me, I would go to court and fight the ticket. Worst case, you'll loose and have to pay the fine. Best case, you win and don't have to pay. It is up to you, wether it is worth the hassle or not.
I wouldn't file a complaint until I won in court. Without the judgement, your complaint will go nowhere.

Every single cop is a total Ahole! period. They're the only people that want and get that job.

Every time I've ever been pulled over (except once.. but my gf at the time started crying which totally worked on the cop - younger guy.. sweeet!, but he was still a bit of an ahole) cops have treated me like dirt. And to this day I still have no idea why the decided to pull me over. Never did get a speeding ticket in my life! I did get one for rolling through a stop sign, and that cop was a real prick.

I hate cops!

Just go to the police station and file a formal complaint using the ticket with the police officer's ID. Just be straight and honest also keep in mind if you do file a formal complaint. The complaint will show that you are confessing to speeding and no seat belt. Here is the issue with the officer and it will screw his record up because for a number of reasons. If a officer has a formal complaint he will not qualify for any promotion and if found guilty he will have a permanent record showing he broke the law as well.

After the the complaint is reviewed and if the officer is found unconduct becoming of an officer....then you go get a lawyer and SUE the police/state/city....where ever it is. The chances are the state will be happy to refund your ticket and clear your record....they dont need people like you filing complaints. Keep in mind the officer should have a camera running the whole time.....get that video and use it against him.

Most important thing.....don't lie or make the story bigger than what it really was.

Yes I am an A$$ and know how to put people in their place.

Officer passed you on the right side of the lane.

Officer showed aggression driving

Officer showed tailgating and reckless for your safety

Officer showed disrepect and aggression with threats of jail for something you complied to officer's demands.

Officer pulled you out of the vehicle needless for 2 simple tickets in the rain out of spite.

You also have a witness your wife!

This is your chance for payback.

Anyone who does not wear a seatbelt is a complete moron. Period. Most people will be involved in a fairly strong crash at some point in their life. A seat belt will make the difference between no injury and severe injury or death.
I think a "no seatbelt" ticket should raise a persons health insurance premiums to compensate the rest of the insured for WHEN the idiot that won't wear their belt is injured.

I personally know three cops that are some of the nicest guys in the world. All three of them are philanthropists. One of them is heavilly involed with the EAA Young Eagles program. One of them started a scholarship fund in his daughters memory (She was raped and killed at college). That fund now exceeds a million dollars a year in free scholarships for disadvantaged families. The third restores junk cars and donates them to charities that help homeless people struggling to get back on their feet.

You are being a total jerk to lump cops like them into the group of a$$ hole cops. Yes, their are a lot of punk cops that need their asses kicked. But, their are a$$ holes in every walk of life.

Why would you not wear a seat belt? If your car gets hit, and you are bounced out of the drivers seat, your car is out of control... That is only going to cause a worse crash than if you were wearing a seat belt in the first place.

When I was in racing school, I crashed my Porsche at over 100 MPH. The car went through a guard rail. It flew over 300 Ft. before hitting the ground (nose first). Then, the car rolled 5 times down a 60 Ft. hill. I walked away with minor bumps and bruises. I am sure that I would have been severly injured or killed, if I had not been wearing my seat belts.... It is pure ignorance NOT to wear your seat belt, and you are endangering others by not wearing it!

I know many cops. Some of them are good, but the majority of them where i live are corrupt and believe that they rule the roost. by corrupt, i mean pulling BS like this cop tried. "Ill take you to jail for arguing with me.." Since when does arguing with a cop break the law? God damn a$$hole. There are good cops and bad....the bad ones are the p1gs!

the number one rule cops should all abide by is:

speak to the public as if you werent carrying a badge or gun.

Theyd get a lot more respect that way.

Too many cops talk down to the public. Too many cops think they are above the law. Too many have forgotten that they merely enforce the law....

I would go and fight this in court. I dont know how it is in florida but here in MA just not wearing your seatbelt is not a primary offence and you can not be pulled over simply for not wearing it. They can get ya for it if you were pulled over for speeding and then get caught without it on. I personally put mine on whenever i see a cop, anywhere!

Im not going to take up for him but here is what ive seen in my past.

I think you can go to jail for doing 10 over. Not sure about that but if he wanted to be a real jerk he could have done that.

He technically did not pass you on the right. Ive had this happen to me before also, but it was in south carolina... He drove beside me for about 10 seconds checking out everybody in the car before pulling us.

I once got pulled on my motorcycle before, on the interstate with my wife on the back, the officer claimed I did not have a motorcycle endorsement and I was doing wheelies going down the interestate. I told him do you actually think I would do that with my wife on the back???.... And Ive had my motorcycle endorsement since I was 18 and my license has the code for motorcycle endorsement clearly printed on it.

Its amazing how some of these guys will try to pick a fight with you... pretty said actually.

But as far as a complaint and getting out of it... its going to be a crap shoot. It will totally depend on how much of a "good ol boy" he is, and how the Captain and commmand views this sort of behaivor. They could look at it and laugh or take it serously.

Edited to add: He can arrest you for argueing with them.. They will state that you are "Impeding thier investigation".

Either way... good luck, and hire a "ringer" for a lawer.

In Mass. if you go and fight a speeding ticket, you first see a clerk magistrate then a judge if you dont like the clerks decision. the magistrate will often times halve the ticket for you. you then have the option of accepting it or going to the judge. going to the judge costs 20 bucks in court fees and time off of work to do so. in MA, an official representing the police department or the officer who wrote the ticket has to show up to defend the ticket. 99% of the time, the representative doesnt show up and the judge dismisses the case. a few hours off work and 20 bucks is a hell of a lot lesss than paying for the ticket and they paying the surcharge the Ins. company will dish out to you.

I'd fight it with the courts, screw the police department. Im willing to bet they'll treat you the same way the officer did in the first place. I filed a complaint once with a department becuase an off duty officer was an asshole. He was yelling at me and beckoning me to fight him. He wouldnt give me his name either. Did i mention that all of this went down right outside of the departmetn HQ? haha. while it was happening, another old crotchedy bastard of an officer piped up and said "why dont you give him a ticket..."

I coulda killed both of them I was so mad.

I'm sure that varies from state to state. Where I live the only reason you can get arrested for speeding is if it's considered reckless driving; I forgot how much over the speed limit that is but it's way more than 10mph.

Dalieo's right he didn't pass you on the right. Legally a pass on the right would be considered if he moved into the right lane, passed you, and then moved back into the middle lane. It's not a pass until you return to the lane you were originally in.

Here's a simple solution.

Two level tiers just like life insurance has for smokers and non-smokers...one for belt wearers and those that wont.

Same as helmet law in florida...you pay more for insurance for not wearing one.

Only "enforcement" from the officers that would make sense (as you indirectly have a right to do to yourself as you please without hurting others...per say) is that of child seats as they cannot speak for themself. Until one day...if daddy does not wear why should I?

but alas...bottom line...its a business after all.

Im positive you got stop for not wearing a belt...a "just" cause to stop and why it wont go away.

Tint your windows.

Wear your seatbelt in the future and the next time he asks you to get out of your car try and get him to meet you at the front of his vehicle where the camera is pointing. Then you can use the video as evidence of him being a jerk. Now I would have politely asked for his badge number and informed him that you were going to file a formal complaint against him if he did not treat you with some respect. Police officers are human just like us so I would think he was just having a bad day but this is Florida! As long as you know your rights, they cannot screw with you but if they think that you don't, then it will be fair game for them. following too close (tailgating) is not something that cops are exempt from... if he was so close to you that you couldn't tell what kind of car he was, he was too close and was putting you in danger.... I don't agree with you not wearing a seat belt, but from the sounds of it, the cop was being a total a-hole and was being overly pushy and aggressive... if anything, I'd take him to court over it... especially since you sped up and tried to move to the right for him. he instigated the increase in speed as far as I'm concerned. this guy shouldn't have a government job. simple as that.

Cops are not above the law and therefore shouldnt be exempt from anything under normal circumstances such as what occurred. The only time they have exemptions is in upholding the law to prosecute a criminal as in chase em down and get em!
