we fly at this old airport, state owned, we only get 2 to 6 full-size landing's and take off's a year, if that,,, well we have this 1 guy that is NOT a club member because he can not afford AMA dues or club dues, but he can afford his POT/WEED and beer, he comes to our field late in the day after the club members are done flying and during the week when most club members are not there, but you could show-up in the week or late in the day on a week-end to fly and he may be there,,,

anyway, he flies drunk and stoned on Pot, so if he flew into an Auto or a person he would not have any insurance !! and he would not have money of his own to pay for the damages,,, the club has talked to this guy a few times that's why he tries to fly when no one is around, but as I said at time there are members that do show-up to fly when he is there,,,

legally we can not make him leave, but we all feel that he is a problem waiting to happen, if he does hurt some-one we are worried the AMA may come down hard on us and we could possibly loose our field,,,

what should we do ????

Ask him in conversation what frequency he is on, !!!!!
Then when he puts his radio down to look at the damage stamp on it.

I think you may already have answered your own question... The field is not yours to regulate..he does not have AMA so you are not being negligent...you have warned him and he is not welcome to fly...he alone would be the responsible party and in no way should AMA have any cause to take any action towards the club. Perhaps a registered letter sent to him and a copy to AMA stating that the club does not wish to accept responsibility for the non member and his actions...also that he is not an invited flyer on that field by your club. That should serve as a formal clarification in case something actually does happen.

Never, under any circumstances, take a sleeping pill and a laxative on the same night.... Dennis

Could you give the cops a call when he's there next. They may have reason to take him away or make it difficult for him to afford more fuel if he has legal fees to pay for.

How does he arrive and depart? If he is driving a DUI tip to the local PD, Sherriff's Office or Highway Patrol might just be the ticket!

He does not seem to be the type to be scared off by a letter, or the police for that matter as he's proberbly had a few run in's with them already, anyway if he isn't doing anything criminaly wrong the police would not want to know.. Haven't you got any big lads in your club that could "talk" to him.?

Look all you have to do is find out what freq he has then when he's flying turn on the radio. Gee must have been a bad servo. Oh what bad luck another crash wonder what happened? Hey didn't you crash here last weekend? What rotten luck to happen again? What 4 times in a row? Maybe you'd have better luck somewhere else you might say.

What ever you do, Don't do anything that would bring you to his level. To hear some one say shoot him down, is wrong. You may not agree with his actions, but to shoot him down. What does that say about yours actions. I don't agree with drugs and flighing a machine that can kill some one. I also don't agree with doing something to some one you don't agree with. Just rise above the problem. Don't have any thing to do with him. If he's not breaking the law when he's there. Nothing you can do. If you smell beer on his breth, just call the cops when he leaves. That is illegal.

I agree with Peter
on state property call the authorities if he is under the influence
of drugs or alcohol. they will take care of your problem
if he comes back stoned call again sooner or later he will go away

If he's indeed under the influence, why not call the cops? We've had 'rogue' fliers show up at our club field, and threatened to have them escorted off by the law. Haven't seen them since they were told.

that is al i can think of to do
i live in holand but if you get drunk here on a airfield/port you are in trouble if the cops see it. no mather what you are doing.
but i don't no what the law is about this in the usa

Jim,

Are you a AMA sanctioned club? If so, does the club have a lease with the state? If so, it should not be a problem getting rid of him via law enforcement. I would check with AMA to see what the best coarse of action should be. They have a legal department to assist with club issues. The only thing I would think you need to watch out for is not to get the State involved as they may see the whole thing as a pain in the a$$ or do I mean a risk and therefore just throw the club out.

what is wrong with just hand delivering a letter to the offender, informing him that he is not welcome there and that his actions may be dangerous to others by his drinking/smoking, that if he damages any property or god forbid, harm somebody, that all effort will be made to incarcerate him. Inform him that if seen drinking/smoking at the feild, that the Police WILL be called to assist in his removal. and then do it.
This way it is all legal above board, and no need to stomp on any of his property or shoot his heli/plank out of the air. I think this approach may be more noble.

The Key here is, that the guy is not welcome there, I dont really give a rats a$$ if a flyer is stoned, untill he damages or hurts anything. Then yep, I will be all over his a$$ for all I can get from him, for him not being responsible in a public place. I say if he wants to fly while spun out of his mind on whatever, he should find his own private place to do that . No reason for anyone to ruin the fun of others because they like to fly stoned and want to shove that up a local clubs butt. I say just pressure them to move on to their own little "weedy, seedy" happy little private smokin flyin club

I have smoked my fair share of weed and done dumb things. But I was 18 at the time and it was the cool thing to do. But flying these things drunk or stoned off one **** is in no way sensible.

If anyone wants to get stoned it's fine with me just don't come flying like it. Do it in your own home or anywhere else but leave social clubs out of it.
