Dear members,

As you've probably heard by now, a federal appeals court today struck down the FAA's registration requirement for recreational model aircraft.

Today's Court ruling is effective immediately. As such, if you have not registered with the FAA, you are no longer required under the law to do so. For those of you who have already registered with the FAA, you may be wondering what this means for you. We are currently working to obtain answers from the FAA and will share more information as it becomes available.

Please keep in mind that this is a fluid situation and there is always the possibility of a renewed push in Congress to compel federal registration for model aircraft. If that happens, rest assured that AMA will continue to advocate for your interests and keep you well informed every step of the way. We have repeatedly argued that federal registration for our community is duplicative and unnecessary, as our members already register their model aircraft with AMA. In addition, our 80-year history of safe and responsible flying demonstrates that we're not the problem. We shouldn't be burdened by overly broad regulations.

Today's ruling also bodes well for our pending court challenge to the FAA's interpretation of the Special Rule for Model Aircraft (also known as the Interpretative Rule). That petition, which AMA filed in 2014, is currently before the same Court that today rejected the FAA's registration rule and affirmed the strength of the Special Rule for Model Aircraft, otherwise known as Section 336. This gives us hope for our continued fight against the Interpretive Rule.

We understand that these policy and legal developments are sometimes dizzying and complicated, and they are rarely resolved quickly. We're nearly three years into our challenge to the Interpretive Rule, for example. We truly appreciate your sticking with us while we press on in the fight to protect your right to fly, free from unnecessary and burdensome restrictions.

The FAA’s Registration Rule violates Section 336 of the
FAA Modernization and Reform Act. We grant Taylor’s
petition for review of the Registration Rule, and we vacate the
Registration Rule to the extent it applies to model aircraft.
Because Taylor’s petition for review of Advisory Circular 91-
57A is untimely, that petition is denied.
So ordered.

Good news for Americans. As it turns out the Department of Transportation and its subsidiary, the FAA, actually has to follow the laws as set forth by Congress.

My impression throughout all of this has been that the AMA thought they saw an opportunity to mandate AMA membership to fly a model aircraft in the US. It is my belief the AMA sought to develop a relationship with the DOT that would require AMA membership and that the AMA would then monitor and regulate model aircraft. In effect the AMA wanted to be what it would have called a SIG, Special Interest Group, for the FAA.

At that moment the the AMA was, in effect, advocating not in the best interest of modelers, but instead for their own bureaucracy.

Things began to unravel when instead of the FAA specifically mandating membership in the AMA, it came out and more generally said, you must operate in accordance with the rules of a "community based safety program". Up until that point I had never heard the term community based safety program; but whatever a community based safety program is, the AMA took that to mean themselves and championed it as a win.

Things totally came unraveled for the AMA when the FAA then came out and said they will register and regulate model aircraft, not the AMA. That effectively left the AMA as nothing more than a voice in the wind whinging on to no one.

Now the AMA truly is without friends. They betrayed their membership in a power play to mandate membership in their club and ironically have been left powerless by the people that were suppose impose membership on us.

To me, it all feels like a train wreck for the AMA .

The AMA needs to create a mission statement -and then read it -often.

WJ you hit the nail on the head. The AMA ended up looking like a bunch of fools in all of this. Instead of fighting for us they actually acted against us. They must have been listing to their lawyers instead of the membership.

Court victory aside, we may see some progress in the DOT, and its subsidiary the FAA, now that the Secretary of Transportation has been replaced with someone actually qualified for the job.

If you care enough, compare the qualifications of Elaine Chao, appointed by Trump, to those of Anthony Foxx, Obama's appointment.

I might interject, and as something of a hijack, I find it endlessly entertaining to note that Democrat Foxx has a daughter named - wait for it - Hillary.

While Chao appears to qualified in her own right, I suppose it doesn't hurt her husband is Senate Majority Leader Mitch McConnell.
