Well unfortunately I got schooled in auto insurance the last couple weeks and I wanted to pass on little info so one day you won't get schooled the way I have.

Start off one morning at work coffee break I go to Starbucks get my usuall as I ve done for the last year or so the large salted mocha latte. I place it in my cup holder of my 04 Honda odyessey with 140k just did trans rebuild two years ago also did timing n water pump seals ect.

So driving back to work I approach intersection it's red. Switches to green 250' out so I keep going! well. So did the dump truck towing a load ,trailer n front end loader who was coming the other way , making a left. So he says he got a green left arrow here in pa we have them. But that would have ment it ended prior to him turning ?? So needless to say he hit me. Luckily I had two witnesses who said the same as me.

So he totaled my van. My neck was in pain, so went to Er had concussion, whip lash,& bruised ribs. Luckily air bag didn't deploy bc I haven't got in line to do the air bag recall yet. Thank god the takata airbags didnt deploy.

So far so good I had full coverage but here in pa we have no fault as far as medical so luckily I not dying from pain as I can't take opiates any how. so not permanently injured but his insu won't rent me comparable can ?? Only a mid size Sedan so I opt for rental van 260$ my end 3??.00 their end.

So It turns out i only had LIMITED TORT instead of full TORT so pissed I can't sue this mother xxxxx who has taken away so much from me worst of which was three days of me NOT holding my baby n two weeks head aches and neck pain ;(

So they totaled my van est 5100 >75% Value I got 7k instead of the 10k I wanted. So always select the full tort. Got a Nissan Murano to replace my van but wish I had my van. It's gonna take some ingenuity getting my carbon Z cub in this SUV

I also think my lipo has a dead cell from accident impact too luckily I not dead or disabled from his negligence. I swear the impact should have had a air bag deploy but car is gone so no way to verify or not. Have no idea if cops did their end bc I can't get in touch with them don't really want to pay for a report ?? I have no idea if he was over weight ?? So opt for full tort full coverage even on older vehicles. I feel like sending the company that's own the truck a rental bill for lacking coverage to accommodate people with comparable vehicles when their st fault

Another thing to consider. A pedestrian walking across a road get hit by sum drunk gives u broken leg. So u think I can sue him. To recoup pain n suffering missed work ect only thing covered is ur medical through ur car insu n if u limit ur self with limited tort ur gonna wish u had full tort.

I read this (head hurts a bit, paragraph breaks please ) and was really confused at first. I had to go look up what the heck is "tort" insurance.

Sounds like living in an at-fault insurance state is a major pain. SOrry about all your trouble.

Said to say Everyone did there part but your insurance agent. He should have sat you down and told you about full and part tort. Yes they sent a letter that was 20 pages long, but a good agent will sit with you and let you ask questions and you could have a discussion when and if things go wrong.

If your agent did this, then you would know if you need extra insurance to cover your self and your assets.

As for the truck being over weight, that dose not really ever get checked after an accident. More kinky if someone died, the insurance company would have it weighed to help with a lawsuit.

Most insurance companies give you Kelly blue book for your vehicle. They also don't pay for recent repairs that you have done to your vehicle.

All in all accidents are bad for everyone. I always wonder why people brake check others and pull right in front of Semi's. They are asking for serous injuries that could take them away from things they love.

Limited tort vs. Full tort isn't about what it will pay, it's about WHAT YOU GIVE UP. So if you have limited tort, and you rear-end me, and I have FULL tort, I can collect pain and suffering from your policy, for soft tissue injuries. If I rear-end you, you CANNOT collect for the same pain and suffering, from MY policy.

You can still collect medical payments and lost wages, and compensation for your car, if you have limited tort. HOWEVER. When someone hits you, the FIRST question their adjuster asks, is "do you have limited tort or full tort?", meaning, "can you sue my insured if you don't like what I offer you?"

I ABSOLUTELY recommend full tort - not only to protect you in case someone hits you, but to give you a more "honest" and forthcoming settlement if the other guy is at fault. An adjuster is more willing to work for you, if you have that hammer to hold over their head.

Most insurance companies give you Kelly blue book for your vehicle. They also don't pay for recent repairs that you have done to your vehicle.
His adjuster came back at me with offer of 5800. but i said had trans rebuilt two years ago and timing belt pump seals ... so i sent adjuster invoice for trans work.she said she could only adj for the parts which was half of the 3800 i paid. She also said send recipts for tires, brakes ect but i dont keep them So I got another grand added to my settlement guess i got lucky i still think it was worth 10k

He had mutual benifits group /selective insurance.

I have State Farm.

After accident I didn't even want to look at the truck driver. Do I ask cop who was doing report. Does he have license ? Yup. insurance ? ? Cop replies yea he has good company with great coverage n gives me a wink ok all I need to know.

Got my new policy only up 40$ month total 110$ for 2012 Nissan murano full coverage with full tort n rental 250comp/500 collision

If the other guy with the truck had his front wheel over the white (stop at) line on a green arrow and you didn't have your wheels over the white line, and therefore he’s in the intersection. Even if your light turned from red to green or was green, the truck driver has the right away to exit the intersection first. Look it up, a green light is not a legal right way for you to enter the intersection without disregard. Did he get a ticket ask your insurance company? Get well.

actually its his responsibility to make sure he has clear road before turning even with a green arrow. and since it turn green for me 250 out of intersection. in far rt lane he had time to stop, weathewr he could or not guess well never know till we get to ? him on the stand.

Not to sure if he was cited going to talk to lawyer on Friday. i understand i not gonna get paid a lot but at least he could possibly determine if i have a case against Honda/takata for non deployment of air bag system ?? or may be get some kinda additional out of his company ?? he was negligent.v I know He was thinking " I am BIG truck all other must yield to me or suffer my wrath. Pos didnt even ask if i was ok mind u i was also being mouthy Saying i hope your company has lawyers on retainer as i am sue the $ h i t e out of you n them.

one min i m driving and the next second i am eating his bumper my lf front was pushed back into the strut tower. frame was lower then his bumper so just sheet metal n plastic to slow the impact. dam seat belt didn't hold either smacked my fore head into steering wheel i woke to him reversing to separate the truck from my van. No "are you ok" just wtf i had the arrow beep beep jolt jolt bang, I M pulling over into that lot.. WTF.
so witnesses came over said "where is he going?" are u ok he hit you, i saw it ,please come sit down.

Gary is right. If that truck was in the intersection turning on a green and it changed while he was turning to clear the intersection, then he had the right of way and you should have yielded to him to let him clear it. Trucks are slow to acclerate and can't stop on a dime. There have been times in a semi truck where I have been first in line and in the middle of the turn due to the heavy load and slow acceleration, the light changes to red. Lawfully I have the right to complete the turn and clear the intersection and not just stop right in the middle and block everyone.

I wonder if he has a dash cam, that would clear up any confusion for sure. having a dash cam is amazing for protecting me, I can't believe how many people get into the 'gotta beat the truck' mode and think I have the ability to maneuver any which way and stop on a dime after they cut me off.

I'm glad you got out without major injuries could've been a lot worse for sure! Stay safe.

Luckily for me I had whitnesses going the sane way as him in the other far right lane n he never got a arrow so we were both moving on green. So it was found he was responsible for making sure he had a clear road which he didn't. Luckily were don't have no fault here exp medical. All medical in pa is no fault so if ur a pedestrian crossing road n get hit. Ur car insu picks up medical cost. If you don't drive or have insu a person in your house hold insu pick it up. If no one in house has car insu it will roll over to his insu as a non insured/ underinsured.

Wish there was camera footage that be the nail in his coffin with my whitnesses tried the local retailers for cc footage but none had any

So yes provided he got a green arrow and proceeded under that arrow he would hold right of way. But in this case he was hope ing for it and with to much speed m weight didn't get arrow n couldn't stop before destroying my vehicle. Big truck syndrome " he better yield to me or else " n he recklessness to see if I was injured before moving truck from accident sceane just goes to show his intent to hide his company and his negligence.
