oh really ?

wanna bet ?... I own a photography studio ...

per the federal goverment : "it is illegal to reproduce, tamper, or modify any copyrighted image "

and it's "copyRIGHT" genius.... it doesn't matter whether or not the image is being used for making money. The creator/owner of the copyright has say so on ANYTHING that is done with the image - be it print quality, it's use, color balance... ANYTHING. Not to mention the models that are used (the people, not the heli) sign a release that is specific for the photos used. The subject may not be happy about a photo being modified in certain ways and they too have a say so in the matter.

Don't believe me ? I can give you the name and number of a company that I shot for that copied one of my images. They weren't making money off of it either, but they simply made color copies of it for advertising to save some money and not buy the prints or copyrights from me. They wound up paying $25,000.00 to me for copyright infringement.

If God didn't want us to eat animals, why'd he make 'em out of meat ?!

when it's your business, and you make money from your work, or your work represents a client, it IS serious. Photography puts food on my table, supports my family, etc. as it does a lot of other pro photographers. So when I see that people just take images, manipulate them, and post their job as what they did, yeah, I get a little pissed off.

If God didn't want us to eat animals, why'd he make 'em out of meat ?!

to be perfectly 100% legal... yes, it's wrong to do ANYTHING to them, even for your own use... of course if nobody sees it, I reckon nobody can say anything....

Actually, I also worked in the Photography industry. Internet photos are considered to be in the Public domain. Unless specifically stated, they may not be retransmitted, reused or duplicated FOR PROFIT.

If, however, the owner of the image (not necessarily the photographer in all cases) requests that the images be removed, then they must be. Or, if the site from which they are taken states same.

The infringement case you speak of involved reuse of unpurchased images. The photographer (you in this case) sold PICTURES, but retained the rights to the negatives. I am presuming, by the statement that you won the case, that your contract for purchase did not release the imagery for reuse. If, however, the client had purchased the photos for use in advertising (standard fare for stringers work) then you would have lost.

Publication on the internet is not the same situation as photography for hire. The images are placed in the public domain and must be explicitly marked as forbidden.

It's a fine distinction, but one that holds in this case. Not having seen the originals, as I found this thread after deletion, unless the imagery came from such sites, duplication and manipulation is permitted by law, especially here where the artist is giving full credit for the originals as well.
