In cases like this, the right of way should always be given to the full size aircraft reguardless of who is in the wrong. It's just good airspace discipline. We as RC pilots can always replace our machines, but a life is not as disposable.

I fly on a military Airbase all the time so, even though I am always a reasonable distance from the airfield, I still have to be aware of full size aircraft from F-18s to Cessnas to HH-60s that are known to to fly directly over my airpace at any given time, low and slow on final approach. Our altitude restrictions are at 700ft and normally our base commander doesn't have a problem until an incursion occurs. If we get stupid I'm sure he'll pull our privilages quick. But, we all make a point to have a spotter to let us know something's coming so we can land or return to a flight pattern under 50ft until it passes. It's the same concept for full size and RC. Always be aware of your airspace and who's in it. Never make assumptions and respect those in the air because you never know what could happen and you don't want to be that guy who brings down an full size aircraft or kill someone becuase you weren't paying attention.

Flying a model aircraft within 5.5km of an airport and at any distance on an approach path is a Federal offence.

Full scale should be 500 feet from other persons...Just because they're bigger don't make 'em right....
I've got enough time in low and slow aircraft to know the field, the operator, and the heli were clearly visible to the full scale pilot...Everybody wants to be an airshow pilot....

Doesnt matter if the plane was going to hit the heli. Dont you get it? One of the pilots, either the heli man or the full size pilot should have been more aware. Even if it was the full size pilots fault, the reporters would have been all over this.
