Only “overt acts” were punishable.
These people are from Topeka Ks, Right?

The funeral they protested at was in Westminster Md.

I would consider traveling over 1100 miles to protest at a funeral of someone you didn't even KNOW as OVERT....

fwiw..

While I abhor the types of protests held by the westboro cult....I fear the "law" even more....Perhaps some kind soul will run over the rev. at a protest...

Sorry Aaron but what you're missing is that rights have limits. It's been that way all along. We've had decency laws that have curtailed free speech since day one. If you don't want to believe that then explain lible and slander laws or why you can't put whatever you want whenever you want on tv or radio. First and foremost the First Amendment was to protect protesting the government which in the day would land you in jail in most countries. It is us that extended it to protecting the right the smear feces on a painting, call it art, and then put it on public display.

Nobody is really saying that these idiots shouldn't be allowed to protest. But that right has to be balanced with the rights of the deceased's family. That's why their protesting should be limited to anywhere but at the funeral service itself. That protects the rights of both parties.

can't curse at the police in some states

In Texas you cannot curse at the police.
Heck you can tell a police officer to go and "f" himself and there is nothing he can do about it, unless you start to get physically violent.

ncheliman, it was not what he said but how he said it.

Quote taken from report: "As for the arrest for cussing, Goetschius said the officers made the decision based on what they believed to have been an “aggressive” statement by Fennell."

So long and thanks for all the fish!

Myself, I'm trying to look at both sides. I do not want the first amendment changed but I also disagree with what these nutcases are doing. Our tax money pays for police escorts for these nuts. This should stop and they should have to suffer the consequences of their actions. If I stand on a corner and yell insults and obscenities at people, will I get a policeman to stand by my side to allow me my free speech. Hell no!!
