I know many of you RC enthusiast are familiar with the all famous and world wide sold Du-bro fuel filler valve, Dubro has been selling this unique and unmatched fuel filler valve for the past 27 plus years and has probably netted hundreds of thousands off sells of this valve, many of you have probably bought one at one time or another. What you did not know is that Dubro had not a single thing to do with the design of this fuel valve, in fact they out right stole it like a thief in the night! How do I know this you ask, simple, in 1976 I watched my father (Rolly R. Hiscott, now 74) talk about designing a RC fuel valve with me, then I watched him draw the plans, then watched him manufacture the fuel filler valve in his machine shop that he owned at the time and market it at the end of 1976. At the time my father had little money and could not yet afford a patten for his product. My father was raising 6 children at the time so money was thin, So my father went ahead and had "patten pending" printed on the fuel filler valve package until he sold enough fuel filler valves to make enough money to actually afford the patten, well this did not stop Mr. Dubro, Dubro looked into the patten (public information) and found there was no patten existing...yet So what did Dubro do? they got a rush patten, copied the fuel filler valve to a T and began manufacturing my fathers design. Out and out stole it right from underneath my father. I have tried many times to contact Dubro and try and get them to man up and show some honor however all I ever get is hung up on! 27 years later I still have in my possession the original plans dated 1976, drawings also dated 1976, original packaging we sold the products in and the original products them selves from over 27 years ago. I have contacted attorney after attorney and there is nothing they tell me that can be done. I myself would just like to hear Dubro admit "just once" that my father is the true designer, Dubro knows he is! In my opinion Dubro is no more then a common thief and are way to stupid to design such a wonderful product!!!! Jim

PS. I would love to hear your thoughts on this dishonorable act by Dubro and what it is that you would do and how you would feel if done to you, think about it....

First of all, it is a patent.

Second, you may have some recourse in the fact that you have the original drawings and can prove that they were drawn before Dubro filed for their patent. I read up on the law once, but it was a while ago.

The burden of proof is yours and very difficult as it then becomes a battle of your word against theirs.

What do you want at the end of the day. Millions, or knowing that your dad designed a great little gadget.

Just my thoughts for what they are worth.

The way I see it is Dubro didn't steel anything. Your dad didn't have a patent and as you stated yourself you can't find a lawyer to touch this.
I also believe the valve design is faulty as every Dubro filler value I have used will start to leak as the spring won't seat the valve after a few uses usually resulting in a air leak and a lean run.
So to me it looks like your dads invention has a design flaw and Dubro should make the changes to make it a better design.

It reminds me of those little flying foam boats that came out a while back. A guy designed them and made a few and posted a video of them before he got a patent on them, and many companies rushed to copy and sell them. He could have been a millionare but got screwed out of it as well.

I believe the original designer was involved with the AirHogs version.

Indeed an interesting story.

The sad thing is that even with a patent and copyright there are countries where intellectual property is not protected and they can copy, sell cheaper and sometimes even improve products without paying a cent to the original designer.

Just look at the heli market!!

Unethical? Yes. Illegal, I doubt it. Just because you thought of something first, or had drawn it first, or even produced one first doesn't mean it is only yours to profit from. It will be a tough to find lawyers to champion your cause. Without the patent or an established business, it was anybodies gain.

Wouldn't surprise me a bit. Corporate = money, bottom line. Couldn't care less if someone died in the process of making money, as long as the attorneys can claim limited culpabilty. 16 years in major corporate and now I walk funny.

In most of the world, patents are based on first to file, not first to invent. While the US is still nominally "first to invent", there are likely to be reforms making it first to file.

The entire patent system is a joke. All a patent proves is that the patent examiner was too ignorant to know who the real inventor was. In my work area, you often see patents filed for (and often granted) for ideas that have been public domain for 30 years!

The Answer

Spelling and spacing may not have been the best, hard to write when your PO'd. No I am not looking to get Millions, however I would like enough (30K) to take care of my father in his last years, Dad is now 74 and very ill and has had 2 hearts attacks in the past 3 years. He may have just a few years left. I would like to make him as comfortable as possible during this time, is that to much to ask! YES, the Dubro fuel valve does leaks! however ours did not, this is do to we used a hire quality O-ring and part tolerances were far better when we were munufacturing the fuel valve. NO, Dubro did not make this fuel valve or designed anything about it! We design and sold it 3 years before the Dubro thief's began selling the valve and in no way would it take 3 years to design a fuel valve of this type. And last, its the principle of the entire deal, who would go as so low to do this, if it were you, you would feel much different about it.
Attorneys have little interest in anything RC unless some one dies do to whatever and I have not the money to pay them up front. No wonder they wont touch it.$$$$ One last question for you, I can hard ass Dubro all I want, send them emails saying what ever I feel and I have said plenty, why is it they never say anything back? Well you know why, I would love for Dubro to get me in court for just being a prick however they never will because they would be asked questions they would have to lie to answer. Thief's! Jim

Well then if Dubro isn't making the fillers to the same specs as yours then you would have a superior product. So that being the case it seems Dubro did not copy your design as they are of lesser quality.
Quit bitching and go on, nobody owes you or you dad anything.
Make a better product and sell it.

Just informing, the Dubro filler placed next to the ones i still have after 27 years are identical, differences can not be seen unless measured in thousands of an inch. Yes they did copy it near to a T, you cant and looks like you wont see that, however on my end having original product in my hand its easy to see. I am soon releasing my Canopies and if anyone dares copy them it will be taken care of quickly and my way right there on the spot at the field, no attorneys needed. I have had enough of dishonorable back stabbing thief's with no vision of there own and no brains to make a difference for themselves.

The reason you can't get an attorney to help is they don't see any money in it. But technically you could prove you were the first to invent it. It would just be so difficult and cost so much that an attorney must play the odds and tell you that you do not have a case. But even if you had a patent you still need to be willing to sue to protect it. It is also possible that the design wasn't so novel that two independent people couldn't come up with it at the same time. Heck, that even happened with the first turbine engine. But anything that works in this hobby seems to be copied the next day.

Your so very right. Anyhow I will ride and hound Dubro for the rest of my life that will in my opinion be maybe 25 plus years, and Dubro will still cower and not have the ball's to man up and show any honor. America, land of the free and the best place to steal other peoples product....Jim
