Most Nascar fans will have heard about this incident if not here we go a couple weeks ago after the race at Talledaga Al Dale Earnhardt Jr accidentally said S&*^ in his victory lane interview and it was aired on National TV Nascar responded by fining Jr 10000 dollars and took away 25 championship points last week someone filed a complaint w the fcc what is this world coming to????
LOS ANGELES -- The Parents Television Council, the nation's most influential advocacy organization protecting children against sex, violence and profanity in entertainment, filed an indecency complaint last Thursday with the Federal Communications Commission against the NBC network for airing Dale Earnhardt Jr.'s expletive after the Sunday, October 3 NASCAR race.

The PTC and its nearly one million members nationwide have asked the FCC to levy a Notice of Apparent Liability against each NBC affiliate that aired the program.

The program that contained the indecent material was broadcast live around 5 p.m. ET and was seen in homes across the country on NBC network affiliates.

"NBC knows that NASCAR has a huge family audience. NBC and its affiliates should be fined for airing the S-word at a time when millions of children were likely to be in the viewing audience," said L. Brent Bozell, president of the PTC.

"After the fact, NBC announced they would be putting all future NASCAR race coverage on a 5-second tape delay. But frankly, NBC should have taken this action long before the Earnhardt incident, especially given NBC's past problems with indecent language during live broadcasts, including Bono's utterance of the F-word during the 2003 Golden Globe awards.

"This is precisely why Congress needs to increase indecency fines. Television networks need to get serious about halting the flow of indecent material over the broadcast airwaves, but that won't happen when the financial penalties can be absorbed as a reasonable cost of doing business.

"We are demanding that the FCC impose the maximum fine allowable under the law against every NBC affiliate that aired this offense. We further demand that the FCC consider license revocation as a real option given the repetitive nature of these offenses," said Bozell.

exactly the thing is this I dont really want my kids being exposed to harsh vulgar language on a constant basis but unless I lock them in their room for the rest of their childhood they will hear it from time to time (probly from me) and oh well is what I say Why are people like this so Naive that they do stupid stuff like this?

It's just the result of Nerf Moms and Nerf Dads. They believe that if you can put enough soft padding on anything (for real, or metaphoricly) that thier kids will never get hurt. I'm surprised bicycles don't have airbags already

The sad thing is that if he does loose the cup by 25 points, he will also loose the millions in marketing that goes with it. Dale Jr is a good guy, him and his team have worked hard to get where they are,his slip was not due to anger but to excitment of winning the race. If you fine the networks for this problem, it will just trickle down to us in one way or another. Put a 5 second delay on live tv and be done with it. If you are offended by what was said then you need to just turn your tv off. I am more offended at the trash that the presidential race is putting on right now, not at the excitement of a guy who won a race. Give me a break!

This may have been trivial in and of itself, but what has happened over the years is the old 'just one more step' mentality. Every year the broadcasters were pushing the limits just a tiny bit further until it finally culminated with the Janet Jackson incident. The public got angry and complained, the FCC responded, and now the slightest little indiscretion is going to cost big bucks. So the pendulum has swung the other way and it's going to be awhile before it swings back so you might as well get used to it.

Hey watch it Chris.....that is almost offensive and subject to fines. Hey great idea...Mark could start a $1.00 per incident fine system, open a paypal acct and sit back and reap the rewards from all of us heathens!!

Actually I think the fines should be imposed with a common sense approach. Saying a four letter anglosaxon monosyllable at a scary or exciting moment should be looked at differently than a middle aged, has been performer with a saggy boob "accidentally" falling out because of a "wardrobe malfunction".

If you have ever seen any canadian TV shows then you'd wonder with all the swearing how any decent family morales could be upheld. I am ashamed that our country would produce such terrible programs ...very dull content with quality cursing...not my idea of a good national broadcaster...thank god for american tv !!

Well, I don't care for NASCAR and I couldn't give a $HIT (oops, am I going to get fined now?? ) About whether Earnhart wins/looses blah blah blah.

However....WTF...OK so nascar fines the guy & takes away some points...whatever...but this whole lawsuite is just another display of one of the many things that are wrong with the leagal system.

How about the Southpark episode where they said $HIT something like 200 times during the episode? They even had a counter at the bottom of the screen counting every time they said $HIT. See any lawsuites over that one? Ok so Comedy Central is on Pay-Cable...but it still falls under most of the regulations that Broadcast TV has...I would think...same reason they can say anything/show anything they want on HBO, but not on any other channel.

Its a bunch of BS...and if all these trial lawyers who do nothing but file frivoulus (sp?) lawsuites were to spontaneously combust on the spot...the world would be a better place.

I think the fine is bogus and taking away championship points is absolutely ludicrious! It's is such a steaming pile o dookie it's not even funny. NBC aired it and if anything, they should be the only ones fined.

The fine and points penalty were nothing more than a necessary formality since earlier in the year two others were caught doing the same thing and got the same penalty so fair is fair that way at the time a few months ago the fcc was leaning pretty hard on everybody after what happened during the super bowl Nascar is already saying that next year there may be a revision to fine a 6 digit number and leave points alone Earnhardts their star like it or not and though they had too they will regret it at the end of the season if he loses by less than 25

Nascar is a private organization and they have rules. Break the rules, your subject to whatever disipline they choose to dish out. Don't like it? go race in another league.

This group sueing isn't stupid at all, they stand to profit. it's very likely they will get a good chunk of coin for thier troubles. Sure they are being opportunists. Sure the incident is being WAY overblown. At the end of the day they have a larger bank account.

It's Aholes like them that expect everyone else to take responsibility for thier kids that are at fault, not nascar, not JR. and not NBC.

We all use a little color from time to time in our communications, if you were so concerned about your kids hearing bad words you would have to lock them up 24/7 like was mentioned above.

I do agree it is most likely just a small group looking for profit.

The sad thing is this ITS not a lawsuit its a bunch of ppl with nothing better to do than to go to the FCC and demand of them as a service of the taxpayers to Fine the Sh&8 out of Every NBC affiliate that aired the race that day so that would be like 200+ stations paying 500gs each they didnt even mention a lawsuit sadly that would make more sense

What the heck were that many of that kind people doing watching nascar anyhow ? Whats next fining them for crashes being violent

It wasnt provanity if it wasnt said on purpose.
Besides it was the media that transmitted it , its their fault, for the fcc violation.

I knew he said something but I did not hear what word it was,,,

now,,, if it is the word "****", then it seems to me that Dale Earnhardt has good grounds for a law suit, because the FCC allows the Steve Miller song "Jett Airliner" to be aired on radio waves and TV, and this song uses that word !!

You guys need to read the FCC regulations on this. Basically the way it works is this, you can say anything you want, until enough people complain. And what can get you fined in one area of the country is not the same as what can get you fined in another part. That where the community acceptability part comes in. Btw, you do realize that this only applies to public broadcast radio and tv? Cable and satelite are exempt.

Btw, you should see how much Tiger is fined by the PGA for some of the stuff that comes out of his mouth during a tourament. And that's for stuff that never even makes it onto tv but is just overheard by someone, even if they needed a boom mic to do it. In fact PGA tour players can be fined and or suspended for "unprofessional behavior" even when they aren't playing golf. That's part of the agreement they sign when they become PGA tour players. I guess that's just part of it if you want to make a stupidly huge amount of money while playing a game for a living.

The bottom line is that there are rules to the game, get used to it. For a long time the FCC looked the other way and let broadcasters stretch the rules and push the limits. Well the FCC is pushing back now.

And in the grand scheme of things, I really don't think that not being able to hear your favorite redneck or whatever cuss on national tv is going to cause your world to come to a crashing halt. So you're just going to have to get used to not hearing %$#@ *&%%$ $^$%#& %$#!!! *&^%% while the main character of the movie puts two shots in the bad guys' head, if it's going to be on regular broadcast tv. You'll just have to be happy with only the gratuitous violence instead.
