Attorney General Eric Holder continues to demonstrate his total incompetence and the failure of the Obama administration as the trial in NYC is falling apart even before it begins.

The Nitwit-in-Charge did not have enough sense to realize the dangers of doing this. NYC has become an even bigger target now.

Lindsey Graham actually got Attorney General Eric Holder to publicly admit that Khalid Shaikh Mohammed will never be released under any circumstance no matter what happens in court.

Then, why have a trial in NYC? Why have a trial in NYC?....the real reason....because Nitwit-in-Charge just saw the brass ring for himself. I'm sorry, I said Nitwit-in-Charge...I should have written Narcissist-in-Charge.

Obama saw a chance to pump up his own image. Khalid Shaikh Mohammed will never be released and every Muslim terrorist knows it.

Khalid Shaikh Mohammed will achieve "living martyrdom" with our liberal media fanning the flames about what an interesting and delightful person Khalid Shaikh Mohammed really is....perhaps we could have all been friends and sung "Kumbaya" on the beach at Malibu if only we hadn't built the evil twin towers.

I think what will happen is that the backlash on this will be so great that they will have to cancel the trial or move it to another country. Problem is nobody would want it held on their soil. In the end, Obama's going to walking around with egg on his face for his ill informed decisions and actions.

Hopefully, its not to late to move it back to gitmo. These guys were nabbed on the battlefield and not mirandized. That fact alone (among many) could easily make the terrorists walk in any court in the USA. Case dismissed on a technicality after potentially millions of tax payer dollars spent. Projections are up to 75 million plus.

Its not rocket science. Its simply a very, very bad far lefty political decision to get the Bush administration. Nothing more. These terrorists have already confessed to the act. That could easily change in a federal court for obvious reasons.

When Holder was asked where the precedence for his decision came from, he could not answer that question because there is none. He's trying to create one. Bad decision because of the obvious risk. Holder is confident he can convict. But, he mentions nothing about what the defense has the capability to do to defend their clients.

The key here is that with all lawyers, their bread and butter is the law and precedence of the law. In other words, has this happened before and how has the law ruled on it?

The answer is that it never has. So, there is no law and the law has never ruled on this before. There is no law on turning over enemy combatants caught on the battle field to federal authorities.

On another matter, it is coming to the surface on the law is that the Attorney General of the US has no authority to order the military to turn over enemy combatants caught on the battle field. The president does have that authority. Further proof that the action is political rather than legal precedence. Thats in addition to proving that Holder lied when he said this whole thing was HIS decision and that he only consulted family members before making his decision.

TAPPER: But isn’t that what is underlying a credible justice system? The idea that if you’re found not guilty, you’ll be free?

GIBBS: No, it’s — I’m not debating legal principles. I’m just not getting into the hypothetical back and forth of what happens on a case

TAPPER: OK. So the Obama administration is refusing to say that if someone is found not guilty, they will be set free?

GIBBS: Jake, I am not going to get into the hypotheticals about specific outcomes of cases.

TAPPER: I’m not asking you to talk about a specific case. I’m talking about in general.

GARRETT: For all the detainees brought to the system — into this system of justice, which this administration said can and has in the past handled adequately — more than adequately, according to your talking points this morning, the terrorism cases brought before it in whatever venue — if that justice system, which the administration says should be trusted, renders a verdict of not guilty, is that person released?

GIBBS: We will talk about what happens about a verdict when a verdict comes.

TAPPER: Well, then how is the world supposed to have any confidence that this new system of justice that you guys are ensuring is going to be the case with detainees, is actually credible?

GIBBS: We think the Southern District of New York has a very good record, as it relates to trying and convicting terror suspects.

TAPPER: I believe what your — the facts sheet said this morning — was that it has a 90 percent success rate.

GIBBS: I think 90 is pretty good.

TAPPER: I’m not questioning whether 90’s pretty good. I’m asking you about the 10 percent.

GIBBS: And I’m, in this specific case, not going to get into those hypotheticals.

Holder said he trusts our federal court system will convict them and give them the death penalty. He is the so called prosecutor and he can say that.

Obama said the same thing out loud in a TV interview with Fox News. Obama saying it is convicting them before they get to court. That makes Obama saying that is unconstitutional and may be enough to drop the case against those terrorists on a technicality among many, many other technicalities.

This whole thing is a bad, bad, bad decision. Very possibly the worst decision of any president in US history.
