From the post you linked, you used the phrase "your canopy condoms" which would imply that it's a generally accepted term for an item (one could also infer that the lack of using it as a proper noun would signify the lack of ownership of said name). You can't trademark "coffee" or "canopy" or "blade", I think you need to brush up on your copyright law (if you ever took any classes). I've done photo work in the past and am quite familiar with copyright infringement. I suppose you can prove loss? But in order to prove loss you would have to actually have a business doing it, right?

Additionally, I looked over your post history and the last time you mentioned something on it was 9/2/04. In fact, you were asking about people buying it but you were unsure at the time. I've searched and couldn't find anywhere that you or your wife were selling them. Of course I could be wrong, the internet is a big place.

As a point of fact, I asked around about a product similar to this about 3 years ago and no one was making them save one place in the UK and they stopped producing them approximately 2 years ago (I know, because I have one). I'm pretty savvy with the net and with contacts in the hobby and I had almost an impossible time finding a cover for my canopy until U-Neak came out with theirs.

But, it's your money.... My suggestion, for a 45 year old with a bum ticker, perhaps you should relax a little bit. U-Neak makes a great product, it's things like your original statement that screw up the fun part of this hobby.

I don't have a bum ticker as you put it. Had 2 valves replaced and all is well.

And someone stealling anothers idea is WRONG , PERIOD, Enuf said and I am talking TM not Copyright . And you won't find any selling or much on RR as we did not pay to advertise here but can show you lots of PM's over the years.

It just comes down to they stole the name I came up with and are making money off it. I probably would have come up with some compromise if asked.

Glad all is well, good to hear. I'd hate to think an issue like this would cause someone to have ill health.

However, trademark and copyright law are tied at the hip. Simply because you sold something with that name attached to it doesn't mean you own it. You also don't have to register said name (USPTO), but in the case of confusion, a federally registered TM beats out a "common law TM" any day of the week and twice on Sunday, but I digress.

I suppose since you mention a history, you can prove a business right to said name (typically this is with a business license stating your defined purpose). But, whatever. Your first post on a "canopy condom" is in 2003 and then in 2004 as quoted below.

Looks like you weren't even sure on it then. Simply because you attach a TM to something doesn't mean you own it. In short, the purpose of the TM is to distinguish goods from one manufacturer to another. Since you said "your wife" made these, it's really her issue and not yours. Secondly, just making them for friends doesn't really qualify you as a "manufacturer". Unless of course your wife had said business license as previously mentioned. But, back to the original point, your quote said you "might talk here (her<sic> into making some but what would one be willing to pay?"

You mention compromise, but you came out blasting with both guns calling them "thieves". Honestly, if you and I were had never met and you walked up to me and called me a thief in front of a large group of people and then tried to back pedal and offer a compromise, I'd tell you to stuff it. Honestly, your approach dictates your outcome. Again, that's me and this issue is up to them. Have you contacted them? I hope you weren't as aggressive if you had.

Ultimately, I'm here to help anyone and I'd hate to see you or them get into a pissing match over something so stupid as a name, regardless of who "owns" it.

i could start a product "called canopy condom ,ribbed for her pleasure" and there wont be much you could do
im glad you didnt invent the light bulb or else all the manufactorers wouldnt be able to call there product a light bulb, oops better delete my post because i mentined someone elses idea by purely mentioniing the word light bulb, it may cause a law suit........get a life

biggest load of rubbish i have ever heard...

And i was a condomn Rep for a world brand, i was calling the M/A canopy covers jonnies and hellie condoms years ago,

it is words, nothing else, if you had a specific logo then you may have an argument, but you dont, just a name,which anyone can use as a figure of speach...

hell we even call rubber gloves over here 5 finger condoms...

Look, if it was your name / idea / TM that was taken and used you would be pissed too. I mean the name canopy condom is unique , I was using before any other in public and for someone to grab on to it and make money off it with out so much as reach around is wrong.

you may want to do another search on the internet then because the first thing that comes up on a google search are two major model heli shops in the USA and the uneak designs, i cant find mention any of your canopy condoms anywhere apart from your own post which claim your wife makes a canopy condom . i dont see you tradeing so i dont see canopy condom being your trade mark.
i came up with the idea to send eletric currents through a home marine aquarium to replicate lightning on a reef that stimulates growth, my idea but hundreds in the uk use it and i belive its catching on in the us do i moan that someone else is useing my idea ...uh no

i get all my canopy covers made by http://www.stitchydays.co.uk/ i got them on my knight 3d, t-rex 450se v2 and synergy, and just as soon as i get around to popping up to see her with my 500, ill get one made for that too. she has the templates made for all raptors, predators, trex 600 e and n and probably more that i dont know about! the first person to have one made for the blitz will have to send her a canopy to make a pattern from, she usually charges £20 per cover i think with embroidery on both sides
